I have sent another email to the editor. Although they have provided an "Amplification" section under this article that says that the item wasn’t intended to imply high-skilled workers are illegal immigrants, the paragraph in which they report the poll result on illegal immigration went under the bold heading "High-Tech Employers". They should either correct this paragraph to exclude any mention of illegal immigration or change the bold heading to a more appropriate general heading on immigration issues.
To their credit, the editor has added a comment for further reading on the legal limbo faced by foreign-born scientists from a page one story written last year.

Technically it should be your original receipt date , thats means your wife 140 should be processed now but guess what that happens only if TSC finds your wifes file , not sure where the tranfer cases are stored , If they use computer they will definetly find the case but looks like they find the cases by boxes ... I m in the same boat and waiting for 140 approval after transfer to TSC , hope they find our box one day

Dude,
I am facing same issue....need to get some money back from India....and there is no way i can get it officially without losing significant part of it. It is really illogical to send money to India for property investment just because we cannot get money back.....I am repenting doing that....
Whenever I ask my friends to do this favor to me.....all they say is they dont have money to send India (since they dont want to disclose their worth to me) or they dont want to send money to India since they know it is useless to send money at such a bad conversion rate.
If you can find some better way, let me know too.

Oh, I trust the attorneys to file it correctly, I was just wondering if there was any way of finding out if it was received and processed correctly. With the H1B, 140, 485, etc. you get a receipt notice, but I wasn't sure if that was the case with the G28, probably not.
The thought of the remote possibility of any correspondence from the USCIS going to the old attorney (for whatever reason), and not making it to me/new attorney in time to respond to it, is a little unnerving.
Well, anyway, no point losing sleep over these things, although it is easier said than done.

I am sorry for the situation you are in. The employer should be punished. Let me ask you:
1. do you have any email correspondance with the employer asking you pay for h1b fee?
2. if you don't then pose him a question using office email something like "how much is still pending on my h1b fee that i owe you (replace you)". Address this to HR or Payroll or the boss it self. Wait for the reply, and then take copy of it for record purpose.
3. if '2' does not work then wire tapping is way to go:

As per the law in New Jersy, one party should be notified and if you are recording you conversation, you are the one party and the other do not have to be notified. Are you using voip in the office? if so use wireshark to record the conversation. If not then there are devices available outside for cheap to do it.
I am not a lawyer, please do some more research and then find a way. If you really want to trap these type of guys there are tons of legal ways to do it. Hope, this helps. Take care. All the best.

A# is assigned during I-140 approval process. Unless you get an approved I-140 from your employer it is difficult to get the A#. BTW, I didnt knew my A# so I just left that field blank and sent I-140 Tracking number instead.

my labor has to be pending 365 days or have an 140 approved to extend. so if pp goes away for 140 then my only option to stay in status is EAD. Also I am not in IT so patni,tcs etc...is out of question.

I renewed my DL in NJ on Aug 31st 2006. The process is the same as in they will verify and give you the license right away. It took me 40 minutes as I went during rush hour.

Thanks lazycis, I mean no disrespect to anyone, just that I find it very difficult to understand some of the ways we all respond towards the events we don't understand. We all simply blame it on God.
And this is the oldest trick in the book of "religious folks". As soon as you question about the twisted belief like "God's protection over this land", some "protecter of God" will throw at you, "people who beleiev in God, will find him". The question is not whether the God exists or not, the question is,
"God's protection over this land"? When we are all children of God, then why would God only protect "only this land". Why not protect other lands where other children of God lives. I think that "God's protection over this land" is a thought from a very inferior mind.
And I find no difference between between "child of God" and "son of God". We are all Sons and Daughters of God, although different religions wants us to believe that their masiah is the "ONLY SON" or "ONLY MESSENGER" of God. And that just too much baloney.
Just like you, I too believe in the existance of God, however, my version of God is not sitting on a lion or a monkey shaped human or tied to a cross or telling us to kill non-believers to go to haven with 72 virgins. I think thats just too pipsqueak depiction of God. I trust that the God is present everywhere but its not what have been described to us by any of the organized religions. And everytime someone throws out some text, like the one Richard Ketchum, I am complelled to voice that its a twisted thought process, which often emanates from the twisted belief system of some organized religion.
Also, Jeffersion, Adams, Franklin and other founding fathers of this nation were all extremely learned because they were all knowledgedable enough to keep the "religion" out of government. My advice to most people who do not perfectly fit into eb2 is to do the eb3 petition first (which is guaranteed to be approved). Get your place in line for the greencard.
If it is taking too long then you can try an eb2 later; if it gets approved then you will get the old priority date. If it doesn't; well you can say you tried but you didn't lost your place in line for the greencard because you still have the old eb3 in place.
However, if your cases is not clear for eb2 and you try this first and it gets denied then you will lose valuable time in line for the greencard because you have to start from the beginning.
Since, last august DOL has become weird with even approving eb3 labors. Generally, attornies will put language in the eta 9089 that they will accept three years of experience for each year of bachelors degree missing (this is in line with education evaluators and uscis).
However, this isn't the same criteria DOL uses. They will state that if a person doesn't have a degree then you are willing to accept 12 years of experience which is excessive and they deny the labor (before they were giving hard time to eb2 but not it is eb3 that they are after). So now we have an issue that DOL criteria is different then uscis critera. You use dol criteria, labor gets approved but 140 gets denied. Use uscis criteria and labor gets denied. Now, everyone has to adjust and file eb3 labors as skilled workers and only require two years of experience (it's getting more and more messy)

yea i hope USCIS completely cleanses the system and gets things back to the way it was pre - 2000
except for mayb 5% of the bodyshoppers ( i could be wrong as i'm not frm IT , have friends who tell me etc) rest all 95% commit fraud to some degree or the other

I'm also going to do a FOIA request for my I-140 that got approved in Jan 08. Employer is saying its their petition and they wont share it. I'm not going into argument because they revoke it now - The Legal Immigration system is too weak and too much lopsided to a "employer" rather than on the "individual employee"
I know during a PD porting to another AC21 employer this approval notice is sufficient even if the I-140 is revoked but my doubt is if my I-140 gets revoked can i switch to another employer and extend my H1B by 3 more years ??
