It is US INS responsibility to ensure no one (mostly Indian IT companies and small companies in US operated from bedrooms, not basement or garage!! :) those created in garage are HP and GOOGLE) can exploit it. Reservation? Yes, it is quite there in my home country. But then, there are many other private sector schools where you can educate your children. After their graduation, they can also work for private sector companies where reservation isn't implemented (yet). If you want to use government facilities only, then yes, you may have issues due to reservation. To tell you the truth, many of us grew up in an environment where people were divided based on cast, religion, geographies and everything else you can think of AND YET a majority of us did well in life. So, if you have it, you'll shine eventually.
In reality, isn't what we are dealing with in the US worse than reservation? Isn't your career restricted? Can you take care of your elderly parents the way you'd really want to? Can you always easily get a basic necessity like a new driver's license? The list goes on..

You are right. But many people came here at the middle of their carrier and they are struck here with their children education etc., They are bound to be here and there is no way. Further, in my country, there are still reservation policies in everything, which may prevent the kids in going in for the education line they like. I donot want to explain this more as I may be degrading my own mother country. In a nutshell, everyone who wish to be a citizen of this country will have lot of valid reasons for getting a citizenship in this country.

I think the current state of disagreement is good because at least everything is out in the open and up for fighting. If this bill had to be scuttled it could have been done very quietly. But there are enough people out there who will make sure that there is no easy death for this bill. It is a fight and a lot of egos will need to appeased in the process.
How much will we gain out of it in the end as skilled legal immigrants may not be necessarily in our control during this whole process as illegal voices are more stronger and we are really considered compromisable. It will be up to our well wisher politicians and vested business interests to push something in our favor.

I called local office of the local congressman. The lady listened to me attentively and then advised me to call Washington office. She said the staff over there would be able to tell me how the congressman would vote on these bills.
I called Washington office also but there the operator said the person who looks into these matters is not at desk and advised me to leave a voice mail. I have left a detailed voice mail with my contact info.
I have to call 3 more congressmen from CHC and I will finish that in a short while.

I have received messages from people who have been here around 10 years without a GC. I wonder how common this is. What do you think about proposing a "fast track" for people who have been here legally for more than a certain amount of time?

I started my GC process again by joining other company but Since My I140 is denied I am in the queue again from the first step the labor process, losing , sept2002 -EB2 priority date.
The get the status of MTR we need to wait for 20 months. 13 months more for me.
1.If you are able to get fast track for MTR s for I140, that is great.Justice delayed is justice denied.
2.Is there any way getting the priority date irrespective of I140 status.
3.what about automatic conversion of EB3 into EB2 if the application is at AOS is pending for 3 years.

Knowing that there are very limited H-1B available per year, do you think this situation is FAIR for the second person or his sponsor company?
Does “first-come-first-serve” or “processing based on date application received” ring a bell? And if second person’s application is not processed, that doesn’t mean that he is not the “best and brightest”, it simply means the quota finished. So why blame others who were ahead in the line and whose applications were processed. Acting like a frog will not make any of us any more human.
The problem is the way we are or would be affected due of some them are not so transparent immigration practices which are mainly from India.
Let see this case, a company sponsor a large number of H-1B to individuals that does not have real job offer, but look for real jobs after they get approved, while a second person does have a job offer but cannot get it because the H-1B quota was reached very early.
If more people on H1 come from India/China and not from Timbaktu, that is because India and China has 1/3 of the world population. It means 1 in every 3rd person walking on this planet is from India or China. If people from India and China consume more H1s and if there is only handful of people coming from Timbaktu, then why complain about it. Send in applications ahead of time because as per the rule, which I am sure no one on this forum wrote, the processing is done in the order of priority of when the application is received. And that is what all the companies are doing, beating the opponent in placing application from their company first.
One more thing, if the immigration bill containing green card reform would have passed last year, H1 numbers would have no t exhausted on day 1. Now please don’t blame H1s from India for the immigration bill not passing last year.

Me and my wife were called for interview at Newark, NJ office after we got the Notice for case transfer in Oct. 2009.
I think the notices we received at home did mention the Newark, NJ office, don't remember for sure.

But I am still not clear if I can apply in EB2 (PERM) as the job requirement says
Minimum of 5 years programming experience
But is really important to SAY THAT’S MASTERS DEGREE PREFERRED,
Because I have Masters in computer science but the job requirement does not need it.
To apply in EB2? Or just BS+5 years of experience is good enough

Just read in another thread that USCIS started producing EAD cards with a slightly different format from May 11. Could this explain why folks who have received the Card Production Ordered emails in May haven't yet received the card, since the switch over to the new card might've delayed the production and dispatch?

My wife and I went for the medical examination 1.5 years ago, when we thought we'll be eligible to file shortly. We still have those sealed envelopes. However, the time passed and I understand we need to undergo the exam again for our June filing, correct?
The first time around my wife had a positive skin test (immunized in childhood) and negative Xray. Back then she was advised to never do the skin test again, as it'll always be positive. So, she'll need to go for an Xray this time. However, she is pregnant, and they don't Xray pregnant women... Is she an exempt then? There gotta be a provision for something like this, right?

They said they would mention the same in 693 document that the test were not done because she is nursing a baby. But this doesnt mean that she is exempted from immunizations and TB test. She would need to come back and do the immunization after 3 months and the doctor would keep a record of it and INS would varify it later with doctor about the test results.
