Visa Bulletin the finger that USCIS gives to all the legal AOS immigrants on monthly basis thus securing more funding through EADs, APs, H1Bs, H4s and what not. Now they want more for FOIA info access.

since it wasn't there i just assumed there is no state chapter.

I just found Feb 08 Stats (http://www.uscis.gov/files/article/APPLICATIONS%20FOR%20IMMIGRATION%20BENEFITS_Februa ry08.pdf) and in Feb 08 there were 787,516 I-485 cases pending. So this might be good news that the backlog is reducing?
Those 197k ( approx ) reduction could be from family based AOS.. until we get data from FOIA , we cannot relay on their information.. Its so broad range of figures they post.
Again who knows when they send us FOAI response.

For EB3 (All countries) to see some light, the changes made recently to the allocation of excess visa, spill over and also to over subscribed countries need to be revisited. Not sure, what triggered USCIS / DOS to revise the interpretation after so many years. Did IV had any role on this, or not .. do not know.. I ask this as based on all forum updates, IV appears to have little success in the Admin Fix area. I have posted this so many times in various threads and did not get an answer, may be there is none. If the interpretation was somewhat like before, EB2 /3 both would have got the spillover... and all would have benefited in the order of PD. Now with the new interpretation. all excess / spillover visa just goes only to 2 countries (EB2 India / China). Looking at the latest numbers based on USCIS website, China has far less cases compared in India based on the cut-off date, which is good for India (EB2), as they now consume a big chunk of the numbers and rest are left out for now. I am not sure, what is opinion on this from folks from ROW (EB3) on this. Does IV has any comment on this... Having said this, I have nothing against Eb2 or EB2 India specific, and not getting into the argument whether or not EB2 need to given much preference.. Hello everyone,
Here's my situation. H-1B for self and H-4 for wife valid through Jan 2010. However our respective visas have expired in Dec 2006. So we'll need to get restamping next time we leave the country. We intend to travel to India this Summer from May through July. Ideally we would like to get the stamping done then during our stay in India. However there is a complication (isn't there ever) since my wife has an employer willing to sponsor her H-1B (starting in Oct 2008). I heard from the gurus here that this will be a COS from H-4 to H-1B and it is strongly recommended not to travel when a COS is pending. I think my options are as follows :
1. Get H-4 visa stamping in India in June while there. Assuming we do a premium processing for my wife's H-1B in April and travel to India after the decision is made (say by May), will there be any problems getting the H-4 visa stamping for my wife in India since we want to return in July before her H-1B starts in Oct?
2. The other option is to get a new H-4 stamping done before applying for the COS in April. This will be either done in Canada or Mexico I guess.
3. Another option is to straight away get the H-1b stamping for my wife in India instead of H-4 but that will cause her to wait in India through October which we would like to avoid.
Personally, we would like to do the first option, just get the H-4 restamping done in June and get back to US by July. But since she'll probably have an active H-1B starting in October, wondering if that will cause any issues when we go for the H-4 stamping.

If the petition is filed as a COS H1, then USCIS should approve it with an attached I-94 unless there are any doubts in which case, it still approves it but without an I-94 and sends a cable to your home country visa consulate where you would have to go and get the visa stamped before Oct 1st and come back to start working...

1) I think what he meant was to take part in the democratic process in the country that you live in. You cannot take part in the democratic process of your native land if you don't live there now can you?
2) I think he means the risk of loosing the GC status and getting deported. Not losing the citizenship of the original country is not the issue. He is emphasizing on the vulnerability.

Alright guys, I cannot tell you how excited I am to report that i got a call this morning from my attorney and my online case status also states that Card Production was ordered for my case!!!
After 8 long years.....i finally have been approved for permanent residency. After 7 years, i will finally, with peace of mind, go back to India to visit my family. Thanks to IV, everyone's help on these forums for helping me keep my sanity over the past 2 years....
After 15 years in the US, I will finally have my green card in hand soon.

I have introduced this concept to several of my friends all of whom are US Citizens and each of them support legal immigrants who are here in the US working honest, legal jobs. Each of them have already promised that they will join Team IV and support the fundraising of $300 per Individual Member to support IV's longterm lobbying efforts.
IV has had some very significant successes over the past year and your continued support via Team IV can help with IV's long term goals.

If you think any fraud is going on or there is a law being misused you must complain to USCIS and Ombudsman. Unless it is reported nobody in a position of power will know about it and nothing will be done to stop it.
I will try to explain the process it takes to get qualified for EB1C.
You will need to be outside USA for an year working as an Executive or manager. Come back to USA in that role. So the appropriate visa will be L1A. Most Indian companies require atleast 5-6 years of experience before they look at your resume for a manager. Most of the managers now a days get fired if their targets are not met in couple of quarters. So staying in that position for couple of years it self is a big deal. Now they need to prove the candiate valid for L1A position. Face a visa interview and come here and start working. Even if the same company is sponsering the L1A. Compaines usually wait for an year or two before they file I140. This application wll rot in CIS queue for long enough before they get a decision and GC.
This is the actual process.. If some company works in an apartment in India with one man show and tries to get an L1A, I am not sure if they will get through and get a VISA??? It is quite common that we have more EB1Cs becos, the number of Desi companies have grown. So if you think you are experienced and want to give a shot, try it. These kind of complaints in a longer run will bite us by delaying the applications and building backlogs..
