i am looking for help in wrongful i485 denial of 485 with ac21 .
Below is my situation .
Company a :
Pd: 12/31/2003
category : Eb2 india
labor cert approved : 3/30/2004
i 140 rd : 4/13/2006
i140 approved dt: 9/21/2006
i 485 sent : 7/2/2007
i 485 rd : 7/5/2007
i485 nd : 7/13/2007
finger print : 9/2/2007
company b :
Joined date: 2/14/2008 (after 6 months)
filed ac21 by company attorney
contacted congressman's office when pd become current for more than a year but no approval. Got response that it is pending in extended review.
Left company b to move south side because of health issue ( winter) .
Company b understood the situation and left in good terms with them.
Company c ( full time )

Everyone knows that King will keep adding ammendments, the only way this bill can pass todays hurdle is if they have some kind of a back room deal where King gets to show he is against the bill but allows a vote towards the end. The fact that he was able to bring up so many ammendments shows that the prior negotiations failed or did not occur. Most of the grunt/real work (deal making) is off the camera, on camera they just pander to their crowds.
King will, as usual, will come up with alot of amendments again. By the way, they have to finish with the horse bill and then they will come to our bill and then they have to finish the nurse bill. All the bills along with the Mr.Kings amendements have to be done in 2hrs because it starts at 3PM and ends at 5PM.

Sorry to hear about your denial.
You haven�t mentioned about your education, maybe I missed it while reading the whole thread.
If your education was equivalent to US Masters (16 years) at the time of filling labor, in your case more specifically MTech or MCA etc. (16 years education) from India, both equivalent to US masters then it�s a wrong denial.

EB is EB3.
I-140 applied in Mar 13, 2007 (not approved yet).

Oh, I trust the attorneys to file it correctly, I was just wondering if there was any way of finding out if it was received and processed correctly. With the H1B, 140, 485, etc. you get a receipt notice, but I wasn't sure if that was the case with the G28, probably not.
The thought of the remote possibility of any correspondence from the USCIS going to the old attorney (for whatever reason), and not making it to me/new attorney in time to respond to it, is a little unnerving.
Well, anyway, no point losing sleep over these things, although it is easier said than done.

I agree. And this has happened. This happens NOT because new Attorney's G 28 did not get filed properly, it happens because VO may mix it up. Usually when a employer requests a revocation of 140 - in real - what the employer requests is "As this employee has left the company the prospects of his future employment with us is not there and we will not support this 140 petition in future. In other words an employer is telling INS "They will never hire you in future".
So the VO does two things here. They send acknowledgment letters to the employer and their Attorney on file and send RFE/NOID to you and your Attorney. In this process some mix up might happen. Remember, a lot of VOs are very ignorant about AC21 and they may not follow the guidelines properly. Under the AC21 law it is clear that all you do is to change job to a same/similar position. As long as you follow law nothing must happen.
Check your online status regularly - if you see LUDs call customer service - verify your address. If you do not get mail in 5 days - call again - if it is 15 days past call and ask them to fax it.

Is there anyone here that truly believes that the legislators will not pass something before the end of the year to recapture the remaining 50K visas left for recapture for schedule A? I got an e mail from customer service this morning stating they had forwarded my letter to upper management.
It(this issue) definitely got to their attention loud and clear, and hopefully it will have an impact of both sensitizing them to this separation in the future as well as prompting them to give our issue more coverage going forward. Perhaps I am being optimistic here, but one can only hope.

Guys,
I keep hearing that "STEM will be exempt from the quota". What EXACTLY does that mean? Does it mean that:
1) STEM's can apply for 485 straight away if labor is approved regardless of PD?
2) STEM's still Cannot apply until PD is current, but after that no more waiting for the country quota

USCIS knows the rules better than you and they DO apply the rules correctly. If you know of a case where there is a violation you are free to complaint to CIS rather than ranting in a public forum.
A correspondence Masters from an ACCREDITED university is legit. As I said earlier, if a degree from a Accredited University is invalid than your degree is also invalid. There are tonns of legit US universities offering Online courses --- some examples are University of South Dakota, University of Massachusetts, Northeastern University etc.
I challenge you --- say in a public forum that degree earned through online courses from these universities are bogus . I will make sure to forward that link to these universities and you can spend more time defending a defamation law suit than anything else.
Looks like you are using online degree to support your case as well, that is why you are so pissed off. No matter how loud you shout or how many people you threaten about lawsuits and all that stuff, no one can deny the fact that an online degree does not have much of recognition.
