Sure, your point is very much valid. What I understand from the Freakenomics experiment and EB3I behavior with respect to IV is that only a few folks have the perseverance to go all the way from D to B.
Take 100 folks with C grade and give them the $50 offer for B. May be 80% will reach that goal. (I do not recall the actual results of the experiment).
Take 100 folks with D grade and give them the $50 offer for B. Ideally we should see 80% of folks improving their grade to a C (one level up). But in real life only may be half as much (40%) will actually improve their grades to a C.
At this point and esp from states like TN, IN, MO, AR, KS, KY, MO, OH, WI, AZ, NV, NM, UT, CO, OR, NE ..... I will gladly take the 40%, why, I will be happy with 20%!!!!!!!!!!!
Members from these states, remember, that your lawmaker will vote on all immigration bills - the questions are 1. whether our provisions are in the bill 2. have we talked to our lawmakers about our issues and 3. will they vote for us? ----- All three tie to our participation and our communication. The reason why most people end up with such situations is that the employers don�t file for H1 extensions on time. Though the law allows filing of H1 extensions upto 6 months before its expiry, most employers file for extensions only at the last moment. It�s advisable to go for premium processing in such cases, so as to get the approvals on time.
You can apply H1 extn earlier than 6 months. Mine was expiring in Sep 07. I applied on Jan 5th 07. Got 7-8-9 year extn in April.

As I see it, hiring a lawyer is still cheaper than losing 20K per year because you are working for a exploitative consulting company. But if the company is treating you well, there is no reason to leave.
I never understood this "exploitation thing". This is America...
If someone is exploiting we all have a choice. We can change employers; go back home, etc.

Immigration is one of the very few issues the President and the Dems agree on. It would be good if this issue gets addressed as early as possible (part of building good faith) before they go back to pointing knives at each other. Which is bound to happen once Dems set up inquiry committees.

My PD is september 2006, I140 approved, DS230 approved, 3 packet approwed or not ( I am not sure, accordig to the last reply from the attorney my case could be even in the consulate), Before the retro began my case used to be a subject for schedule "A"( nurse), now I am in EB3...
The question is - will I receive my appointment to the interview soon(next month), because all forms have been accepted already, or I have to wait for all cases with PD older then mine to pass before my case???
One more question.
I am not in the US. Should I try to go to the US, and then(after 2 months) apply for I485, before the retro will start again in september??? Is it necessary to have I485 approved in order to receive legal status or it just have to be filled and applied? Will I lose my place in the consular processing after applying for the adjastment of status?
I know , too much questions, sorry for that but I am realy confused, and badly need your help and advice!

Why are we discussing this subject when it will do nothing to take us closer to getting the GC? In almost each social event, I have heard this subject being talked by my fellow friends. But discussing it on IV forum does not serve much purpose.
To me, it seems in the conversations about this subject (not just this thread, even in social events), each person is trying to find a group of people that agree to his or her thoughts. That makes the group then feel better. But what do we all do the next day, pray that we get the GC fast. People who want to really go back to their country do not take much part in these discussions. They just pack up and go.
If we are spending any time on IV, it should be focussed on our effort to get the GC. Or to help someone of us facing an immigration related issue.

Just out of curiosity how many of those 60% were citizens? I know a lot of friends who have put in extra 5 years to get the citizenship.
I think aging parents is probably the biggest and valid concern a lot of ppl have.
I think there are plenty of people who always planned to go back .. the GC /USC was just a career advancement tool for these people. In fact, a survey of US returnees to India after 2000 shows that the majority (around 60%) were USCs/ GC holders, which is clearly an indication that the relocation was by choice rather than any immigration issues.
And finally, many of us have family issues like taking care of aged parents which either makes the re-location inevitable or in some cases may coincide with career goals.
I have seen that most ppl who have been here for over 5 years have almost fallen in love with the possibilities. They talk about going back to take advantage of the booming growth but very few actually do go back.
Or maybe some of us came here precisely for the reasons you mention, seeking greener pastures but fell in love with the openness, informality and the possibilities here .

at least they are approving 2003/2002 PD applications as we have seen.....now that surelymeans they are working a little bit....
Whether they are short on staff, or whatever teh reason maybe, the bottom line is our complains to any higher ups/Senators..etc will just fall on dead ears as we are not the Voter Base.....
