No Material Change, except i can go to Canada on business trips without any hassle and dont have to get fingerprinted while re-entering US
- What did you do on the day you received it?
Since i had gotten the email from USCIS that its in mail - so no surprises
- How did the long wait upset your life?
I only waited 7 months - so no upsets - even before my GC was filed - i was in US for only about 2 years or so - so no big deal - in those 2 years - my employer did not discriminate in terms of promotions/ pay hikes etc. I had bought a house even before my GC was filed and spouse could work because of my L1 status
- How did immigrationvoice help you during this long wait?
Not Applicable since IV is not really focused (and rightly so) on my GC category
- Would you like to continue your support to immigration voice and help others waiting?
Sure - some of my closest friends are in H1B and i see how the long wait affects them and their families - having said that - i like to make up my mind (rightly or otherwise) about which initiatives are good or bad/ effective or ineffective- so as and when I see initiatives i get excited about like flower campaign, letters to various lawmakers etc- happy to help
- Any advice for everyone?
GC and Citizenship should not prevent anyone from pursuing their career and personal dreams - if not US - there are other countries where your skills would be welcome. Personally - i have given priority to career and family life ahead of visa issues and rest has automatically fallen into place

The bill states failing to show evidence of your immigrant status, is a misdemeanor and will result an arrest. So this is going to trouble a lot legal residents to prove they are legal and there will be a lot of litigation as a result of this.
See how Mr. Blog feed has omitted the fact that this law is against "unauthorized alien". To a casual observer it would appear that IV supports such endeavors (promoting illegal immigration).

I found some things in our favor:
1. Cap exempt H1B holders can now work for cap subject employer CONCURRENTLY without being counted to cap
2. 3 year H1B extension based on approved I-140 can be as many times as needed, not 'one time' only
3. Once you have an approved I-140, you will never be subject to H1B cap:
(4) Exemptions to Limitations of Stay. The limitation on the total period of stay does not apply to H-1B aliens when, as of the date of filing the extension request:

I TRansfered my H1 B Visa first time in the August 2006 from Company A (GC Sponsering Company) to Company B.
Everything went good.
Last year in March i did transfered my H 1 B to Compnay C from Compnay B
and i July last year i applied for my I 485, and got my EAD in Sep 2007.
Now the total 180 days have been passed am i eligible for AC21 and if yes then what are the formalities to get AC21.
Also Compnay A has told me earlier that they will revoke my I 140 but i do not have any means to know wether they did revoke or not, how do i know if they revoked my I 140 is there any way to find this out.
Your Help Will be a big Help for me
As you said I 485 filed + 180 days. So you are out of danger.

Did you get a notice from CSC saying they are transferring your I-485 to NSC? If so, when was it?

If we will get EADs, let's see who are gonna be our friends and enemies:
Lawyers. They are never our friends. If you are on H1b, then you better do every extension through the lawyer. If your H1b extension will be denied, you are in trouble. If you are on AOS/EAD cycle - you don't need a lawyer. It's a simple application. If for some reason your EAD denied (because you screwed something up in application), you will just reapply - it will not affect your status. If you will have a gap - just take leave without pay, to be formally compliant. So.. lawyers will lose, if we will all jump on EAD.
Employers. Believe me, so many consulting companies will be out of business for good, because a lot of folks will just join other companies for better salaries. It will be no more slavery, no more intimidation. For a lot of employers "f$%4 off" will be the usual thing they hear. So they won't like it.
Average American. We will be able to compete with them directly and kick them out of many positions. It's a capitalist country, and competition is a key to prosperity. It is much harder to find a job on H1B than with EAD. Yes, average American employee is undereducated and overpriced, and with a lot of demand and drama. Successful companies will love to hire us.
US government. They will like to get us on EAD, because we will start having higher salaries and will be paying higher taxes. We will start paying yearly EAD/AP fees. So, in this case DOS is on our side.

GC arrival does change the life little bit. My frequent anxiety regarding various renewals like EAD, AP, H1/H4 vanished along with the tons of documentation that I have to do for those. I was struck to my current job during this process and continued the same way even after GC, but I am about change that soon. GC now provides me the ability to compete with others in the open market and provide me the confidence.
- What did you do on the day you received it?
I just went to the Temple and thank God for finally receiving it during my life time!
- How did the long wait upset your life?
More than me, it upsets my wife a lot. This does take a toll on her as she is confined to home and occasional voluntary services. She is now vigorously pursuing for a job in this down market and finding it difficult to compete with others, who have recent US job experience.
- How did immigrationvoice help you during this long wait?
IV helped to be better informed about various processes, procedures. This also helped me to deal with the attorneys directly by-passing the paralegals, who have little knowledge and to get the attorney�s much needed attention to my cases.
- Would you like to continue your support to immigration voice and help others waiting?
Yes. I do visit the forum from time to time and provide my experience and get updated with the changing rules, regulations and the visa status.
- Any advice for everyone?
As we are the people in no man�s land, I would suggest every one to be united to support the noble and good cause to revamp this system. I was driven away by the infighting and bickering and do not understand what benefits that is going to provide. Though I understand the pain, frustration and agony for the uncertain wait for this process, I would like to remind everyone that this is the time where we may need to be more united and welcome others instead of fighting among ourselves.

IN RESPONSE to AKRED: My dads priority date is july 2005, so how does that give me amnesty...he applied under PERM!!! Btw if you do not support DREAM ACT than you shouldn't be on this forum...

There is a lot of bad rap that we the legal immigrants have to face because of the rampant illegal immigrant problem, most of the folks here gets peeved off if an act has a bias towards that.

Even today i came across a friend saying according to his so and so friends thinking , EB2 should move very fast as last time it jumped from 2002 - 2004 or what ever in 2 months !!!!... There are lot of people who dont understand the depth of the problem , the yearly limit , country quota etc..
I think the only way to make them understand is to tell that since 1 million people are in queue and only 140K GC per year , your GC will take any where from 8-15 years.. :)

For example, stock brokers used to charge $200 and above for stock trades; however, electronic brokers came and made the industry efficient and hence can profit more by charging only $10 or even less. High investments in R&D in general is good for economy but not necessarily true for a company. For example, German manufacturers are best R&D shops; however, their over investment in precision is precisely their problem. On the other hand Apple copied mp3 music players from Creative and made millions. One can find countless examples of skilled marketing (services) not innovative products making money. So don't assume that R&D investments are always good for a company.
Finally, Wipro & the likes -- they have already opened up shops in China, Mexico, Brazil (yes)... and finally if dollar falls further they could actually buy the US companies and make them efficient (Honda and GM example).
As long as quick money can be invested into wise investments, it can be safe. But do remember, to build anything from scratch is a pain, but to manage and service it is easy. All the easy money, if invested in long term growth will be very benefitial to humanity

This is a very valid point. If employer or his lawyer asks more money in fees for filing I485 it is always better to go thro employer if he files I485 promptly. But if the delay is intention of the employer then use your own Lawyer.
USCIS can deny I-485 application if it is missing "initial evidence". In this case it is approved & active I-140 and Employment Verification Letter from GC Employer.
Also, the USCIS published a new rule that allows the USCIS to have more discretion over shortening of the time frame for responses to RFE from previous 12 weeks to any period of time which they see fit.

There are more risks in using AC21 before 140 approval.
Read the Aytes memo of Dec 2005 regarding portability before 140 approval. There is all kinds of things that can go wrong if you port off to a new employer before 140 approval.
Other than employer withdrawing 140, the other issues are that if there is an RFE on your 140 and you have already used portability and ported off to new employer using EAD, then what would you do if that 140 doesnt get approved. Because if your H1 6 years have been used up, you are on EAD status, and your underlying 140 tied to 485 doesnt get approved, then it means you are out of status and you are out of luck. You cant even stay here to appeal the whole thing, you have to pack up and go back.

Since we already applied for I-485, I am keeping my fingers crossed. Her employment letter (submitted) only says that she is employed with the company and her employment is valid till 2008.
Isn't valid/unexpired I-94 counts as legal status not the approval notice. Also what if the employee takes a un-paid leave of absence due to health reasons etc.
I am sure so many in the same boat. Is there anything we could do?
